EVOLUSI KAFA’AH DALAM HUKUM KELUARGA ISLAM: TINJAUAN PUSTAKA SISTEMATIS TENTANG INTERPRETASI KONTEMPORER DAN DINAMIKA SOSIAL

Abstract

This study aims to systematically review, map, and analyze the academic evolution of the concept of kafa’ah (marital equality) in contemporary Islamic family law, exploring how traditional jurisprudence interacts with modern social dynamics, gender equality, and state legal systems. Adhering strictly to the PRISMA 2020 guidelines, this study employs a Systematic Literature Review (SLR) design to screen, extract, and synthesize global scientific publications regarding kafa'ah from the past decade. The synthesis reveals a profound paradigm shift from an ascriptive-collective model focused on social stratification (lineage, wealth, and status) toward an individual-substantive model. In contemporary contexts, kafa’ah metrics have mutated into merit-based achievements, such as educational parity, moral integrity (sex morality), psychological readiness, and mutual financial vision. Furthermore, failing to assess moral equality is empirically linked to household disintegration and increased divorce rates among working wives. This paper provides the first PRISMA-based systematic framework that bridges the gap between fragmented regional ethnographic data and classical texts, establishing a unified conceptual model of kafa'ah transformation. This study introduces the Evolutionary Kafā'ah Framework, enriching Islamic jurisprudence by demonstrating that Islamic family law is a highly responsive system that harmonizes classical doctrines with modern civil rights through legal methodologies like tarjīḥ and maqāṣid al-sharī‘ah
