Abstract

This study examines the reconstruction of digital monitoring regulations for the implementation of child support judgments following divorce at the Medan Religious Court. The study is motivated by the gap between the normative regulation of child support obligations and the effectiveness of court judgment enforcement, which still largely depends on voluntary compliance by the obligated party and formal execution procedures. The research aims to analyze the implementation of child support judgments, identify the legal basis for reconstructing digital monitoring regulations, and formulate a reconstruction concept to strengthen the protection of children’s rights. This research employs a normative legal method using statutory, conceptual, and case approaches. Legal materials were collected through library research and analyzed qualitatively using a prescriptive method. The findings indicate that both Indonesian positive law and Islamic law adequately regulate child support obligations; however, they do not provide administrative regulations governing post-judgment monitoring to ensure continuous compliance. Accordingly, this study proposes the reconstruction of regulations through a digital monitoring system as part of post-judgment administration to record, monitor, and document the implementation of child support obligations without altering the existing execution mechanism. The proposed reconstruction is expected to enhance the effectiveness of court judgments, strengthen legal certainty, and optimize the protection of children’s rights based on the best interests of the child principle.
